Terms ofService

These Terms of Service govern your access to and use of Phynixo (“Phynixo”, “we”, “our”), an AI canvas platform for creators. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

Phynixo provides a node-based canvas where you can run AI models for image generation, image editing, video generation, upscaling, and 3D, across creative workflows including architecture, advertising, photography, fashion, product design, and brand. Specific models, capabilities, and limits evolve over time and are documented at /pricing and in the in-product UI.

To use Phynixo you must create an account with accurate, complete information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised access. You must be at least 18 years old to create an account.

• Phynixo runs on a credit-based system. Each model run consumes credits based on the model and resolution selected. Current costs are displayed in the workspace before you run a node.
• Subscription plans grant a monthly credit allowance. Allowances reset at the start of each billing cycle and unused credits do not roll over unless explicitly stated for a given plan.
• Subscription fees are billed in advance and are non-refundable except where required by applicable law.
• You can upgrade, downgrade, or cancel your plan at any time from your account settings. Changes take effect at the end of the current billing period.
• We may change pricing with at least 30 days' notice; changes apply at your next renewal.
• Payment processing is handled by a third-party payment processor. We never store full card numbers on our servers.

You retain all rights in the content you upload and in the outputs generated from your prompts on Phynixo. By using the service, you grant us a limited, worldwide, royalty-free license to host, store, transmit, and process your content solely to operate the service for you. We do not use your uploads or generations to train our own models.

You are responsible for ensuring you have the rights to upload, prompt with, or otherwise process the content you bring to the platform.

Many model runs are executed through third-party providers. Your prompt and inputs are transmitted to the chosen provider at run time, subject to that provider's policies. We pick providers with policies aligned to ours and surface model attribution in the canvas.

You agree not to use Phynixo to:

• Generate content that is illegal, defamatory, harassing, or that infringes third-party rights.
• Create non-consensual intimate imagery, sexual content involving minors, or deceptive imagery of real people for the purpose of harm or fraud.
• Infringe intellectual property rights: do not upload or prompt with content you do not have rights to use.
• Upload malware, attempt to compromise our systems, or interfere with other users' access.
• Resell, sublicense, or white-label the service without a written agreement with us.
• Circumvent usage limits, abuse free trials, or use automated means to extract data not intended for export.
• Violate applicable laws, sanctions, or export controls.

We may suspend or terminate accounts that violate these rules. Severe or repeated violations may be reported to authorities.

AI-generated content is probabilistic. Outputs may contain errors, artifacts, or biases, and may not match your expectations. You are responsible for reviewing outputs before using them, especially for commercial, public-facing, or safety-critical contexts. Free-plan exports may include a Phynixo watermark; paid plans provide watermark-free exports as documented at /pricing.

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or modify features. We will give reasonable notice for material changes. Some features depend on third-party providers whose availability is outside our control.

You agree to indemnify and hold Phynixo harmless from any claim, damages, or expense (including reasonable legal fees) arising from your use of the service, your content, or your violation of these terms.

To the maximum extent permitted by law, Phynixo and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or business opportunity) arising from your use of the service. Our aggregate liability for any claim shall not exceed the amounts you paid us in the 12 months preceding the claim.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or available at all times, nor that AI outputs will be accurate, reliable, or fit for any specific use.

You may cancel your subscription at any time from account settings. We may suspend or terminate your account if you breach these terms or engage in abuse. Upon termination, your access to the service ends; we retain or delete your data per the retention rules in our Privacy Policy.

These terms are governed by the laws of the jurisdiction where Phynixo is incorporated. Any dispute that cannot be resolved informally will be brought before the competent courts of that jurisdiction. If any provision of these terms is held unenforceable, the rest remain in effect.

We may update these Terms of Service from time to time. Material changes will be announced by email or in-product notice at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
